Trusts & Estates
Our estate planning practice focuses on minimizing income, estate and gift taxes when preparing Wills, Trusts and other estate planning strategies. We ensure that the clients’ goals and elder law personal issues are addressed in structuring their estate plans.Lifetime gifts, transmitting wealth, and establishing family charitable foundations for families may be desirable. We have substantial experience in organizing and advising public charities and private foundations, and in creating complex trusts as part of charitable giving programs. We also have expertise in forming and maintaining family limited partnerships and limited liability companies as part of an overall estate plan for transmission of wealth, ownership, and control of family-owned businesses.
We handle all aspects associated with an estate or trust administration, including preparation of Court accountings, estate and gift tax returns, and in some instances fiduciary income tax returns.
With attorneys admitted to the States of New York and Florida, we are capable of handling estate and trust planning and administration matters of our clients and their families. We work closely with our litigation, business, tax, corporate and environmental departments when necessary to ensure that we properly address all aspects of our clients’ situations. Some of our attorneys are also certified public accountants and others have advanced tax degrees.
In order to provide services economically, our Trusts, Estates and Elder Law group makes appropriate use of specialized paralegals and advanced computer programs in the estate planning and administration areas.
Elder Law
We focus on assisting the elderly and their families with complex legal and family issues, including preservation of assets, long-term care planning, eligibility for governmental benefits including Medicaid, disability planning, establishing supplemental needs trusts and participation in guardianship proceedings. We provide advice and counsel to ensure that your future planning is securely in place with the appropriate Trusts, Wills, Health Care Proxies, Livings Wills, and Powers of Attorney. We also handle all aspects of long term care planning, including protecting assets to enable the family member to qualify for Medicaid, as well as the preparation and submission of a Medicaid application.Estate & Trust Litigation
We are experienced in handling all aspects of estate and trust litigation, from Will contests to complex contested accounting proceedings. Timothy B. Thornton: Over 40 of years’ experience in planning for the orderly and tax efficient transfer of wealth during life, and after. Mr. Thornton is a Fellow with The American College of Trust and Estate Counsel, and former chairperson of the Trusts and Estates Law Section of the New York State Bar Association.
Richard D. Cirincione: Department Chair with a concentration in the areas of estate planning, estate administration, estate litigation, guardianship law, and elder law. In addition to the New York Bar, he is admitted to the Florida Bar. Prior to attending law school, he worked as a Certified Public Accountant.
Amy S. O'Connor: Practices in all aspects of estate planning, estate administration, guardianship law and elder law, with a focus on assisting elderly clients and their families with legal and tax issues, as well as long term care planning. She is a frequent lecturer on numerous elder law and estate planning topics. She serves on the Executive Committee, and is Chair of the Legislation Committee, of the New York State Bar Association’s Elder Law Section.
