Significant Cases
Miller v. Cloud, 263 B.R. 183 (2001)
In representing a creditor, Mr. Pastore obtained the dismissal of a debtor's bankruptcy case based upon debtor's bad faith (Bankruptcy Court found bad faith where debtor frustrated only two creditors while making substantial payments to remodel girlfriend's house, taking trips to Hawaii and St. Martin immediately before filing bankruptcy petition and purchasing a $3,500 engagement ring eighteen days after filing of his petition). Miller v. Cloud represents the successful defense of that win in that Mr. Pastore successfully resisted debtor's request for a preliminary injunction pending appeal enabling the creditor to enforce its rights without delay.
